In a market with a lot of second hand cars, it is possible to develop an intuitive feel for the “proper” valuation of any particular vehicle. Make a fuzzy assessment of make, model, age, kilometres, condition and colour, and – bang – with a dose of intuition, and a survey of the relevant range of comparative valuations on offer, we get the value of the car. $5 – 7,000AUD. The problem with such an impressionistic valuation approach is that it doesn’t scale. It works well enough when there is an established market within which the individual car can be placed, but it doesn't work when there is no relative comparative vehicles. The approach, for instance, would not work if you needed to value a space shuttle. There are no other space shuttles against which you can compare the milage and brand of this one to arrive at a sensible valuation. The exact same problem is present in the law when we are trying to ascertain the settlement value of a case. In instances where there are many homogenous cases, like personal injury settlements, the exercise is easier. We simply compare our case with the range of homogenous cases we have seen in our experience, and arrive at the sum. “A back injury like yours is worth $100,000 on a good day”. But in instances of UNIQUE pieces of litigation, this approach fails us. We cannot make an impressionistic valuation based on a range because there is no relevant range of cases to compare with. Often, it is said that in unique, complex cases with no relevant precedent that valuation is impossible. But just as in with the space shuttle, valuation is not impossible. It just requires a different, ground up technique. My preferred approach is through the use of decision trees, which turn a lot of people off because they require the use of numerical percentages to evaluation the chance of different scenarios playing out (like, there is a 78% chance the court will allow this evidence), but in my experience give us the best, most defensible basis for valuing the unique, space shuttle, litigation. Has anyone in my network had experience with a similar system? Another approach? It’s an important topic because if you cannot sensible value these large unique cases, (like many construction cases) it’s hard to settle.
